HomeView™ Privacy Policy

Introduction. HomeView, Inc., a subsidiary of SofTech, Inc. ("HomeView") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide through using our HomeView service ("HomeView") either by visiting our website https://HomeView.com (this "Website") or through the HomeView mobile applications (the "App"), and our practices for collecting, using, maintaining, protecting and disclosing that information.

This policy applies to information we collect:

(a) On Website.

(b) In e-mail, text and other electronic messages between you and Website.

(c) Through App that you download from Website or through an App Store such as Apple iTunes or Google Play (the "Store"), which provides dedicated non-browser-based interaction between you and Website or Store.

(d) When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy. It does not apply to information collected by:

i. Us offline or through any other means, including on any other website operated by HomeView or any third party; or

ii. any third party, including through any application or content (including advertising) that may link to or be accessible from or on Website.

PLEASE READ THIS POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE WILL TREAT IT. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOUR CHOICE IS NOT TO USE HOMEVIEW. BY ACCESSING OR USING HOMEVIEW, YOU AGREE TO THIS PRIVACY POLICY. THIS POLICY MAY CHANGE FROM TIME TO TIME. YOUR CONTINUED USE OF HOMEVIEW AFTER WE MAKE CHANGES IS DEEMED TO BE ACCEPTANCE OF THOSE CHANGES, SO PLEASE CHECK THE POLICY PERIODICALLY FOR UPDATES.

Information We Collect About You and How We Collect It. We may collect several types of information from and about users of HomeView, including information:

(a) By which you may be personally and specifically identified, which are defined solely as name, postal address, e-mail address and telephone number ("Personal Information").

(b) That is about you, but individually does not identify you.

(c) About your Internet connection, the equipment you use to access HomeView and usage details.

We collect this information:

(a) Directly from you if you provide it to us.

(b) Automatically as you navigate through HomeView. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons and other tracking technologies.

(c) From third parties, for example our business partners, including Store.

Information You Provide to Us. The information you provide to us and we collect through HomeView ("User Provided Information") may include:

(a) Information that you provide by filling in forms on HomeView. This includes information provided at the time of registering to use HomeView, subscribing to our service, posting material, or requesting further services (including, without limitation, backup or password recovery services that we may provide through third parties). We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with HomeView.

(b) Records and copies of your correspondence (including e-mail addresses), if you contact us.

(c) Your responses to surveys that we might ask you to complete for research purposes.

(d) Details of transactions you carry out through HomeView.

(e) Your search queries on HomeView.

(f) Any other information that you provide to third parties that may eventually be associated with HomeView (whether or not you link to them through HomeView), including, without limitation, Store, Dropbox, Evernote, Apple iCloud, et cetera.

HomeView may use user Provided Information without limitation of any kind whatsoever whether or not account holder deletes his or her account or transfers ownership of the property to which the User Provided Information applies.

You also may provide information to be published or displayed on public areas of HomeView, or transmitted (publicly or privately) to other users of HomeView or third parties, such as by way of example without limitation, a portion of your database to your friends, family or co-workers through Dropbox or other third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages or we may allow you to set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of HomeView with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Children Under the Age of 17. HomeView is not intended for children under 17 years of age. No one under age 17 may provide any information to or on HomeView. We do not knowingly collect Personal Information from children under 17. If you are under 17, do not use or provide any information on HomeView, or on or through any of its features/register on HomeView, use any of the interactive or public comment features of HomeView, or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 17, we will delete that information. If you believe we might have any information from or about a child under 17, please contact us at privacy@HomeView.com.

Usage Details, IP Addresses, Cookies and Other Technologies. As you navigate through and interact with HomeView, we may automatically collect certain information about your equipment, browsing actions and patterns, including:

(a) Details of your visits to HomeView, including traffic data, location data, logs and other communication data and the resources that you access and use on HomeView.

(b) Information about your computer and Internet connection, including your IP address, operating system and browser type. The information we collect automatically is statistical data. It helps us to improve HomeView and to deliver a better and more personalized service by enabling us to:

i. estimate our audience size and usage patterns;

ii. store information about your preferences, allowing us to customize HomeView according to your individual interests;

iii. speed up your searches; and

iv. recognize you when you return to HomeView.

The technologies we use for this automatic data collection may include:

(a) Cookies. A cookie is a small file placed on the hard drive of your computer or mobile device. When using Website, you may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of Website. Unless you have adjusted your browser setting so that it will refuse cookies, HomeView will issue cookies when you use Website. HomeView will always use cookies in App.

(b) Web Beacons. Pages of HomeView may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us to count users who have visited those pages or for other related usage statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

How We Use Your Information. We use information that we collect about you or that you provide to us, including any Personal Information:

(a) To present HomeView and its contents to you.

(b) To provide you with information, products or services that you request from us.

(c) To fulfill any other purpose for which you provide it.

(d) To provide you with notices about your account.

(e) To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.

(f) To notify you about changes to HomeView or any products or services we offer or provide through it.

(g) In any other way we may describe when you provide the information.

(h) For any other purpose with your consent.

Disclosure of Your Information. We may disclose aggregated information about our users without restriction. We may disclose Personal Information that we collect or you provide as described in this privacy policy:

(a) To our subsidiaries and affiliates.

(b) To contractors, service providers and other third parties we use to support our business.

(c) To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of HomeView's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by HomeView about HomeView's users is among the assets transferred.

(d) To third parties to market their products or services to you IF YOU HAVE CONSENTED TO these disclosures.

(e) To fulfill the purpose for which you provide it. For example, if you share your database with your friends, family or co-workers or use any social applications to "tell a friend" about HomeView, we will transmit such contents and/or your e-mail address or other details to the recipients.

(f) For any other purpose disclosed by us when you provide the information.

We may also disclose your Personal Information:

(a) To comply with any court order, law or legal process, including to respond to any government or regulatory request.

(b) To enforce or apply our Terms of Service and other agreements.

(c) If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HomeView, our customers or others.

Choices About How We Use and Disclose Your Information. We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

(a) Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of Website may then be inaccessible or not function properly. We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

(b) Accessing and Correcting Your Information or Recovering Your Password. You may send e-mail to support@HomeView.com to request access to, correct or delete any Personal Information (including, without limitation, recovery of your password) that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If you delete your User Contributions from HomeView, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other HomeView users or may be stored on third party applications, such as Dropbox, Evernote or Apple iCloud that you may have used to store your User Contributions. Proper access and use of information provided in HomeView, including User Contributions, is governed by our Terms of Service.

Data Security. We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. We use Microsoft Azure to store your information. Their security processes are detailed here: http://azure.microsoft.com/en-us/support/trust-center/security/. However, the safety and security of your information also depends on you. Since you have chosen a password for access to HomeView, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of HomeView or sharing any of your information or database with your friends, family or co-workers. The information you share in public areas may be viewed by anyone. Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in HomeView.

Changes to Our Privacy Policy. It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' Personal Information, we will notify you through a notice on Website's home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting Website and this privacy policy to check for any changes.
